Terms and Conditions

I agree & release Heather Corbet LLC of any & all liability/responsibility for any actions or in-actions. Heather Corbet LLC is not held liable for any direct, indirect, incident, consequential, or punitive damages arising from using these services. Heather Corbet LLC is not liable for actions on behalf of the client out of negligence or fraudulent misrepresentation. 

If Consultation, you understand the following: Consultant defined: Brings expertise in a particular area in which a consultee needs or wants to improve. Consultants work with the consultee, student, organization, healer, business person in partnership to ensure outcomes that support goals and a strategic plan of the individual. These consultations do not constitute clinical supervision and that I remain completely responsible – ethically and legally – for the decisions I make in my own clinical practice with my clients. My consultant will provide me with an opportunity to discuss clinical cases and issues about which s/he may have some expertise, and s/he may help me consider choices for responding, but the comments made for my consideration are not supervision mandates. I also understand that although we may sometimes need to discuss personal issues that may be relevant to my clinical work, these consultation services do not constitute psychotherapy. I understand the potential limits of the confidentiality of this relationship. To the extent possible, my case presentations will provide no identifiable client information. However, I understand that if I provide identifiable information about a situation and my consultant has an ethical or legal obligation to report, s/he will inform me at the time and will give me the opportunity to make the report myself.

I understand that if my consultant becomes aware that she knows or has a prior relationship with a presented client(s), or if she believes she has a potential conflict of interest with our relationship, she will notify me of that fact immediately and will cooperate in helping me find a referral for further consultation.

You are purchasing Heather Corbet LLC’s services. The following Agreement is the Terms of Service. Please read it carefully. If you do not agree to the following terms, DO NOT purchase Services. By purchasing Services, you are accepting the following Agreement, & agree to & are bound by the following terms.

1. Parties: For purposes of this Agreement, you (the purchaser) are referred to as “Client.” Seller, is referred to as "Heather Corbet LLC.”

2. Term: The engagement of services begins on the first date of service & ends on last date of service

3. Payment: Client agrees to total fee charged at the time of service. Special payment arrangements will be decided on by Heather Corbet LLC.

4. Cancelation or reschedule: must be made 2 business days prior to appointment time. If cancelation or reschedule is not made 2 business days prior to appointment time, client is responsible for full payment of session time slot that was canceled or rescheduled session & no refunds are made.

5. Rescheduling: If a session is rescheduled 3 or more times, even with the 2 business day allotted time, session will be canceled & time slot which was rescheduled will be paid in full. 

6. Refunds/Returns: Heather Corbet LLC does not offer refunds. Deposit can be applied to future session or class.

7. Confidentiality: Any information discussed or any information either party comes to know during Heather Corbet LLC & Client’s one-on-one work together is confidential. This does not include information information that either party was aware of prior to executing this Agreement, nor does it include information that was gained by a third party, or information that was available to the public through no breach of confidentiality by Client. Confidential information may be shared if & only if waived by both parties in writing.

8. Non-Disparagement: Client agrees, during & after purchase of Products, to refrain from making any statements, whether oral or in writing, that negatively impact Heather Corbet LLC’s program, business, services, products, or reputation. In addition, Heather Corbet LLC agrees to refrain from making any statements, whether oral or in writing, that negatively impact Client or Client’s business.

9. Assignment: This Agreement shall bind both Heather Corbet LLC & Client & their respective heirs, legal representatives, successors, & assigns. Client may not assign its rights under this Agreement without express written consent from Heather Corbet LLC.

10. No Guarantees; Disclaimer: NO GUARANTEES: Heather Corbet makes no guarantees of potential outcomes following session or consultation.

11. NOT PROFESSIONAL MEDICAL ADVICE: At no time should any of Heather Corbet LLC's services, products, or programs be considered a substitute for professional medical or mental health services, nor should the service be construed as professional therapy. Heather Corbet LLC’s services are not intended to treat, diagnose, cure, or prevent any disease. If at any time Client needs medical, and/or psychological treatment, it is Client’s responsibility to seek it out.

12. NOT LEGAL OR FINANCIAL ADVICE: At no time should any of Heather Corbet LLC’s services be considered a substitute for professional legal or financial advice. If at any time Client needs legal or financial services, it is Client’s responsibility to seek it out.

13. Warranties: Both Heather Corbet LLC & Client warrant that they have full authority to enter into this Agreement. Heather Corbet LLC warrants that its services will be provided by qualified people & in a competent manner in accordance with industry standards. Client warrants that s/he has any necessary permission, licenses, rights, & releases to lawfully execute its duties set forth in this Agreement. Except for the express warranties in this agreement, neither party makes any ohter warranties either expressed or implied. 

14. Whole Agreement: This Agreement constitutes the entire agreement between Client and Heather Corbet LLC. This Agreement supersedes & cancels all prior or contemporaneous discussions, writings, negotiations, and agreements.

15. Modification Waiver: The terms of this Agreement cannot be modified, supplemented, or amended unless agreed to in writing by all parties. In order to make the waiver binding, the party making the waiver must execute it in writing. The waiver of a term in this Agreement shall not be considered a waiver of any other terms of this Agreement and shall not be considered a continuing waiver. The modification or waiver of one term of this Agreement does not affect any other term in the Agreement, regardless of its similarity.

16. Severability: If any term in this Agreement is found to be void or voidable, the remaining terms of the Agreement are unaffected, and deemed to remain in full force and effect, including those terms that are similar.

17. Limited Liability: The amount of liability recoeverable for any cause of action that arises under this agreement shall not exceed the amount paid for services outlined in this agreement, regardless of whether the cause of action is based in tort, contract or any other tehory of liability. Under no circumstances will Heather Corbet LLC be liable for special, incidental, indirect, or consequential damages of any kind, or for any loss of use, business interruption, costs of procurement of substitute services, lost profits, or lost data, even if client has been advised of the possibility of such damages.  

18. Notices: All notices and communications required or permitted under this Agreement shall be in writing and shall be deemed given when delivered by registered or certified mail, postage prepaid, addressed to the party’s principal place of business, unless otherwise clearly stated in this Agreement that email notification shall suffice.

19. Dispute Resolution; Costs and Fees; Applicable Law/Venue: Any dispute arising under this Agreement will be resolved by an online mediation service that is agreed upon by all parties or by a mediation in Wisconsin with a mediator agreed upon by all parties. The parties agree to complete mediation in good faith prior to pursuing any other available legal or equitable remedies.

Parties agree that this Agreement shall be governed by and construed in accordance with the laws of Wisconsin. Parties agree that the venue for any court proceedings arising out of this Agreement shall be in Dane County, WI.

If Client takes legal action toward Heather Corbet LLC & Heather Corbet LLC is successful, Client is responsible for Heather Corbet LLC's attorney’s fees, in addition to any other relief to which Heather Corbet LLC may be entitled.
